MusoTec Guarantee Conditions

Guarantee terms of conditions, according to § 477 BGB - special provision for guarantees

3 YEARS MUSOTEC GUARANTEE

Parallel to the legal warranty we provide a 3 year's guarantee according to the following terms. The MusoTec guarantee is granted exclusively to those products, which carry the indication "3 year's MusoTec Guarantee" on the respective offer side. Otherwise, the legal warranty and liability for defects applies.

1.1 - Description of guarantee

  • Minor problems can be solved via remote maintenance software or video session. If the problem is due to a defect in the device, the product will be send back to us for repair.

  • We repair minor defects ourselves, so that the repair time is reduced to a minimum.

  • A loan device can be made available for the duration of the repair if the availability permits this. However, a basic claim does not exist and depends on the current availability of loan devices.

  • The repair of a defect which is recognised by us as being covered by the guarantee is carried out in such a way that the defective product is repaired free of charge or replaced by a faultless, e.g. reconditioned product, at our choice.

  • If a device is found to be "irreparable", we will replace it with a new one. If the same model is no longer available, we will offer you an alternative product in the same price range and with similar features.

  • If the case under section 1.1.5 occur, we charge the full purchase price of the item over the entire guarantee period to a new product. The new product is determined by the customer and must correspond to or exceed the value of the original article.

  • Replaced products or parts become our property. 

1.2 - Display of the guarantee claim

  • A guarantee claim must be notified in written form and within the guarantee period and before the return of the product. Please send a short e-mail, a fax or a letter. After acceptance from our side, the product must be sent to MusoTec with a copy of the invoice.

1.3 - Conditions

  • The guarantee period begins with the delivery of the product to the customer.

  • Is granted exclusively on the products purchased at MusoTec.

  • Can only be claimed if a copy of the invoice is presented.

  • Can only be claimed during the guarantee period. 

  • Extends geographically to the Federal Republic of Germany, Switzerland and the EU.

  • The guarantee is due to the customer, who is a consumer according to §13 BGB, and cannot be assigned to third parties.

  • The guarantee is due to the customer, who is a business customer according to $14 BGB, and can not be assigned to third parties.

  • Defects must be proven to be due to material or manufacturing defects.

  • Claims other than those mentioned in the guarantee conditions are excluded.

  • The guarantee for the product is neither extended nor restarted by the provision of guarantee services.

  • If further manufacturers or product guarantee exist, this will be indicated in the article descriptions.

1.4 - Exclusion

  • Products which do not show the note "3 years MusoTec guarantee" on the respective article page.

  • Products that are subject to usage-related wear and other forms of wear, as well as financial ineffectiveness.

  • Defects in the product resulting from ignorance of operating instructions, improper use, abnormal environmental conditions, improper operating conditions, overload, arbitrary damage or lack of maintenance or care.

  • Defects caused by the use of accessories, supplements or spare parts that are not original parts.

  • Products on which unauthorised modifications, additions or repairs have been made.

  • Minor deviations from the target quality which are irrelevant for the value and usability of the product.

  • So-called exclusive products, unless otherwise stated on the article page. Exclusive products can be recognized by the reference "Exclusive product" on the article page.

The customer's legal warranty rights are not limited or eliminated by these guarantee conditions.

The legal warranty rights for defects shall not be limited or eliminated by these guarantee conditions.

The customer's legal 14-day right of cancellation is not limited or eliminated by these guarantee conditions.

28 DAYS MONEY-BACK GUARANTEE

The 28 day's Money-Back-Guarantee is granted exclusively to those products, which carry the indication "28 day's Money-Back-Guarantee" on the respective offer side. Otherwise, the legal rights of cancellation applies.

1.1 - Conditions

  • You can initiate a return by sending us an e-mail and waiting for our declaration of acceptance. 

  • The return period begins on the following day, on which the legal cancellation period has ended, for a further 14 days.

  • The customer, who is a consumer according to § 13 BGB, is entitled to the right of return and cannot be assigned to third parties.

  • The article including accessories must be in perfect condition. A proper opening, handling and treatment of the goods and packaging, as well as the accessories, start-up and testing in accordance with the operating instructions, we assume.

  • Should the customer make use of his right of return, we are entitled to demand an appropriate usage fee for the time the product remains at the customer.

  • Furthermore, the customer who makes use of his right of return must compensate us for the reduction in price or the value of the goods insofar as he cannot return them in proper condition because he is responsible for the worsening, loss or other impossibility. In addition, the customer can avoid the obligation to pay compensation by not using the product as if it were his property and by refraining from doing anything that could affect its value.

  • If individual components of a bundle or set are returned, the articles remaining with the customer will be invoiced at the regular sales price.

  • Returned items will be subjected to a technical and visual inspection. This ensures that a new customer receives proper goods. Payments are refunded immediately upon completion of the inspection. For the refund we use the same payment method which was used by the customer with the order. 

  • Claims other than those stated in these terms and conditions are excluded.

  • The guarantee extends geographically to the country of the Federal Republic of Germany, EU and Switzerland.

  • Applies to distance contracts according to § 312c BGB.


1.2 - Exclusion

  • Products which do not show the note "28 day's Money-Back-Guarantee" on the respective article page and all promoted, financed products and those paid by invoice.

  • In principle, the right of return is not granted on articles which have been manufactured according to customer specifications or which have been ordered on customer request.

  • Unnecessary activations or registrations of items and accessories, which are not relevant for the main function and test of the item, as well as in case of detection of financial inefficiency.
